Howard W. Campbell: When my brother and his wife started the adoption process, the social workers were practically begging him to take little Dontavious off their hands. The state would even help out with most of the costs. If you would assume the care and feeding of a “Dontavious”, a (minority) cripple, or a crack baby, money could be found to help with the adoption expenses.

I would rather pay the 35k up front and avoid all of the issues that blacks will have when they hit the teenage years. While I am not a big fan of it, I can understand why parents will adopt Chinese girls. Sometimes, it takes an act of God to adopt a healthy white child, and if you are too “old” forget it. All of these celebrities who are adopting racially correct children are going to be in for a rude awakening in 10 -15 years.

(Reuters) – The U.S. Supreme Court delivered a landmark victory for gay rights on Wednesday by forcing the federal government to recognize same-sex marriages in states where it is legal and paving the way for it in California, the most populous state.

As expected, however, the court fell short of a broader ruling endorsing a fundamental right for gay people to marry, meaning that there will be no impact in the more than 30 states that do not recognize gay marriage.

The two cases, both decided on 5-4 votes, concerned the constitutionality of a key part of a federal law, the 1996 Defense of Marriage Act (DOMA), that denied benefits to same-sex married couples, and a voter-approved California state law enacted in 2008, called Proposition 8, that banned gay marriage.

The court struck down Section 3 of DOMA, which limited the definition of marriage as between a man and a woman for the purposes of federal benefits, as a violation of the U.S. Constitution’s guarantee of equal protection under the law.

The ruling was a victory for President Barack Obama’s administration, which had decided two years ago it would no longer defend the law in court. Obama applauded the DOMA ruling and directed U.S. Attorney General Eric Holder to review all relevant federal laws to ensure that it is implemented.

Justice Anthony Kennedy, 76, appointed to the court by Republican President Ronald Reagan in 1988, was the key vote and wrote the DOMA opinion, the third major gay rights ruling he has authored since 1996.

In a separate opinion, the court ducked a decision on Proposition 8 by finding that supporters of the California law did not have standing to appeal a federal district court ruling that struck it down. By doing so, the justices let stand the lower-court ruling that had found the ban unconstitutional.

Chief Justice John Roberts wrote the Proposition 8 opinion, ruling along procedural lines in a way that said nothing about how the court would rule on the merits. The court was unusually split, with liberals and conservatives in both the majority and the dissent.

By ruling this way on Proposition 8, the court effectively let states set their own policy on gay marriage. This means a debate is set to continue in various states via ballot initiatives, legislative action and litigation potentially costing millions of dollars on both sides of an issue that stirs cultural, religious and political passions in the United States as elsewhere.

The rulings come amid rapid progress for advocates of gay marriage in recent months and years. Opinion polls show a steady increase in U.S. public support for gay marriage.


Gay marriage advocates celebrated outside the courthouse. A big cheer went up as word arrived DOMA had been struck down. “DOMA is dead!” the crowd chanted, as couples hugged and cried.

Paul Katami and Jeffrey Zarrillo, a gay couple from Burbank, California, who were two of the four plaintiffs in the Proposition 8 case, were both outside the courthouse.

“We are gay. We are American. And we will not be treated like second-class citizens,” Katami said.

He turned to Zarrillo, voice cracking and said: “I finally get to look at the man I love and say, ‘Will you marry me?'”

Before Wednesday, 12 of the 50 U.S. states plus the District of Columbia recognized gay marriage. Three of those dozen – Delaware, Minnesota and Rhode Island – legalized gay marriage this year. California would become the 13th state to allow it.

About a third of the U.S. population now lives in areas where gay marriage is legal, if California is included.

“We are a people who declared that we are all created equal, and the love we commit to one another must be equal as well,” Obama, the first sitting president to endorse gay marriage, said in a written statement.

While the ruling on DOMA was clearcut, questions remained about the meaning of the Proposition 8 ruling for California. Proposition 8 supporters vowed to seek continued enforcement of the ban until litigation is resolved. But California Governor Jerry Brown, a Democrat, said the justices’ ruling “applies statewide” and all county officials must comply with it.

“We are now faced with this unusual situation where we have some uncertainty,” said Andrew Pugno, one of the Proposition 8 proponents’ lawyers. He expressed satisfaction that the Supreme Court had “nullified” a San Francisco-based 9th U.S. Circuit Court of Appeals ruling that, if left intact, could have had set a precedent for other Western states in its jurisdiction.


By striking down Section 3 of DOMA, the court cleared the way for legally married couples to claim more than 1,100 federal benefits, rights and burdens linked to marriage status.

Kennedy wrote for the majority that the federal law, as passed by Congress, violated the U.S. Constitution’s guarantee of equal protection. “The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and to injure those whom the state, by its marriage laws, sought to protect in personhood and dignity,” Kennedy wrote.

The law imposed “a stigma upon all who enter into same-sex marriages made lawful by the unquestioned authority of the states,” he said.

Roberts and Justice Antonin Scalia both wrote dissenting opinions in the DOMA case.

Roberts went out of his way to state that the court was not making any big pronouncements about gay marriage. The court, he said, did not have before it the question of whether states “may continue to utilize the traditional definition of marriage.”

Scalia accused the majority of ignoring procedural obstacles about whether the court should have heard the case in order to reach its desired result.

“This is jaw-dropping,” he said of Kennedy’s analysis.

As a result of the DOMA ruling, Edith Windsor of New York, who was married to a woman and sued the government to get the federal estate tax deduction available to heterosexuals when their spouses die, will be able to claim a $363,000 tax refund.

The ruling was a win also for more than 200 businesses, including Goldman Sachs Group, Microsoft Corp and Google Inc, that signed on to a brief urging the court to strike down DOMA. Thomson Reuters Corp, owner of the Reuters news agency, was another signatory.

“Today’s decisions help define who we are as a people, whether or not we are part of the group directly affected,” said Lloyd Blankfein, Goldman’s chief executive.


Numerous public figures including former President Bill Clinton, who in 1996 signed the DOMA law, and prominent groups including the American Academy of Pediatrics have come out this year in support of same-sex marriage and gay civil rights.

Individual members of Congress – Democrats and Republicans – also voiced new support for gay marriage this year.

Even with recent developments, there is still significant opposition among Republicans, including House of Representatives Speaker John Boehner, who had ordered the House to intervene in the DOMA case in defense of the law. Boehner said in a statement he was “obviously disappointed in the ruling” and predicted that a “robust national debate over marriage” would continue.

While more developments lie ahead, the legal fight over gay marriage already constitutes one of the most concentrated civil rights sagas in U.S. history.

Just 20 years ago, the Hawaii Supreme Court ruled that its state constitution could allow gay marriage, prompting a nationwide backlash and spurring Congress and a majority of states, including Hawaii, to pass laws defining marriage as between only a man and woman.

In 2003, when the top court of Massachusetts established a right to same-sex marriage under its constitution, the action triggered another backlash as states then adopted constitutional amendments against such unions. Five years later, the tide began to reverse, and states slowly began joining Massachusetts in permitting gays to marry.

Question DiversityWhen thinking about this case, I put myself in the position of a Supreme Court judge. (Yeah, I know, from my mouth to Allah’s ears.)

The hypothetical me on SCOTUS would like to find for Miss Fisher, but I can’t think of any Federal Constitutional grounds to do so. Just between everyone reading these words and the gatepost, we all know that this Top 10% was done precisely as a seemingly non-racial end run around the concept of blatantly race-based AA, because we all know that the valedictorian of taco or ghetto high schools in Texas isn’t as worthy as someone from a difficult competitive white high school who finished one person below the top 10%. But what am I supposed to use as a rationale to find for Miss Fisher? Am I to use the doctrine of disparate impact? (Which the real SCOTUS will take up next term). Except I don’t think the disparate impact doctrine should even exist. If it shouldn’t exist to invalidate police and fire department entrance and promotion exams, then it shouldn’t exist to knock back this top 10% system either. The doctrine of strict scrutiny of racial classifications at law? First off, I think intermediate scrutiny should be used on race, and second, there are no racial classifications de jure in this case.

If there was some paper trail somewhere that proved that the authors of the top 10% policy specifically and explicitly did it because of race, then I suppose I could use strict scrutiny to declare it an illegitimate racial classification, if I was given to do that.

One more thing from SCOTUS: You’re reading a lot of hemming and hawing in the breaking news that SCOTUS borked the Voting Rights Act and namely the preclearance provisions. They did no such thing. All they did was order that the DOJ come up with a better, more timely more up-to-date formula on determining which jurisdictions have to do preclearance. They did NOT find the Federal government’s power to require preclearance of some jurisdictions but not all unconstitutional, much less find the whole notion of preclearance unconstitutional much less the whole VRA unconstitutional. IOW, in the heart of the matter, they found for the Feds/VRA.

As Blacks get all of these assistant programs, AA quota privileges and racial preferences, they still make up less than half of the college campus in relation to the state’s Black population. If I were Asian I would be disgusted by the governmental support blacks receive who have hardly earned their admissions in relation to Asians.


AvatarDan RoodtInitially when the news came out yesterday, it looked for a moment as if the SCOTUS had moved a few inches away from endorsing race preferences, but Jared’s disillusioning commentary is by far the best I have read so far.

He is also correct about the University having all the funds and the time in the world to litigate against white individuals whom a few smaller non-profits might assist in trying to defend their rights.

The one thing that struck me in reading some of the arguments of Miss Fisher’s lawyer last year, was the typical tendency of lawyers to be cautious and not tackle the issue head-on. As far as I recall, he did not attack the notion of “diversity”, but simply argued that UT was already diverse enough not to exclude Abigail Fisher on racial grounds.

This also happens a lot here in South Africa where we have to fight name changes and language discrimination (against Afrikaans) in the courts. Ultimately, one gets a sense of “winning the battle but losing the war”. Sometimes a case is won on some technicality but the principle is left untouched.

If it makes sense at all to litigate against the state or huge institutions like universities, almost against all odds, one should attack the core principle, such as “diversity” or race preference itself. Even if the outcome is then negative, at least the hostility of the SCOTUS against whites would have been revealed, the emperor seen to be naked as it were.

As things stand now, the issue has been fudged and the lower court will probably keep it that way. So UT will just invent another another abstruse requirement to exclude whites without actually calling it racial.

Some time in the future demographics will change and white students will be a minority on campus. At that stage universities will not argue that they need more “diversity” in the form of white students, but the remaining whites will be punished for “past privileges” enjoyed by their parents and grandparents.

I strongly feel that universities with their “tenured radicals” are leading the way as far as the downfall of the West is concerned. There must be some way in which they can be boycotted or isolated in order to neutralise them.

Deciding not to decide – it’s a way for the Supreme Court to deal with a contentious issue by awaiting more clarifying opinions from the lower courts.

In a 7-1 decision regarding the closely watched affirmative action case Fisher v. University of Texas, the Supreme Court remanded the case back to the federal district court from which it came with instructions to give the matter greater scrutiny.

This is a partial victory for opponents of affirmative action because the lower court upheld the formula used by the university to admit minority candidates to its law school.

Wall Street Journal:

The court’s ruling on Fisher v. University of Texas was 7-1, with the majority opinion by Justice Anthony Kennedy. Justice Ruth Bader Ginsburg dissented, and Justice Elena Kagan, who was solicitor general when the Obama administration weighed in on the case, recused herself from the decision.

Justice Kennedy said the Fifth Circuit U.S. Court of Appeals made legal errors when it upheld the university program. The lower court should have scrutinized the university program more strictly, Justice Kennedy said.

The justices were ruling on the case of Abigail Fisher, who alleged the university rejected her because she is white.

Justice Kennedy said the Supreme Court wants the lower court to hear the case again “so that the admissions process can be considered and judged under a correct analysis.”

UT gives automatic entry to any Texas student who graduates in roughly the top 10% of his or her high-school class. That program was designed to maintain ethnic and racial diversity after a 1996 federal-appeals-court ruling restricted affirmative action in Texas and nearby states.

But after 2003, when the Supreme Court voted 5-4 to reinstate affirmative action, UT quickly supplemented its top-10% plan with an additional admissions pathway that allowed consideration of race and other factors beyond grades and test scores. UT said that pathway was designed for middle- or upper-class children of African-American and Hispanic professionals who attend more competitive schools.

While the top-10% plan vastly expanded the number of Texas high schools sending graduates to the state’s flagship campus, UT administrators frowned at having to accept applicants from less competitive high schools, whose top students often had lower test scores and poorer academic preparation than middle-tier students from leading suburban high schools that traditionally served as the university’s principal feeders.

The university said the presence of better-off minority students could help dispel stereotypes that could be perpetuated by the presence of those admitted through the top-10% program.

The problem for the university is that it is seeking to redefine the very concept of affirmative action, and in so doing, make admission to the school race-based regardless of economic circumstance. In questioning the lawyers during oral arguments, Justice Kennedy and Justice Alito put it succinctly:

“I thought that the whole purpose of affirmative action was to help students who come from underprivileged backgrounds, but you make a very different argument that I don’t think I’ve ever seen before,” said Justice Samuel Alito.

When UT’s lawyer, Gregory Garre, attempted to explain the admissions formula as a “holistic” review of individual attributes, Justice Kennedy heard something else.

“So what you’re saying is that what counts is race above all,” said Justice Kennedy, considered a swing vote on affirmative action. “You want underprivileged of a certain race and privileged of a certain race. So that’s race.”

Indeed. The 2003 decision  Gutter v Bollinger said that race could be only one factor in admissions policies. The school’s effort at a work around that used both race and economic circumstances to admit minority students but discriminate against whites of the same economic background was at issue.

The lower court could re-issue a similar opinion, addressing the issues in a more technically pleasing way to the high court. Or, it could split a few more hairs and send it back to SCOTUS for a more definitive decision.

Either way, we have not seen the last of this case – or of challenges to affirmative action.

Yesterday, I talked about how John Derbyshire’s “advice” to White parents on what to say to their kids about black people was the right idea with the wrong messenger. You can see my column here.

And while Derbyshire’s racist suggestions got him fired from the National Review it doesn’t mean that most White parents out there are doing a particularly good job to talking to thier kids about race.

So, I know you’ve all been waiting patiently to see … drum roll please:

The Talk for White Parents to their White Kids about Black People

In this day and age of Black presidents, a Black First Lady that still makes a White man’s head explode and George Zimmerman killing a defenseless Trayvon Martin in cold blood, you’ll need it.  It will come in handy White people, so read carefully. Don’t just open for emergencies, depending on what’s an emergency to you.  But, this should work for:

1) The first time your kid asks why there’s a Black history month

2) The first time they come to you asking about the word “nigger;” and

3) Just about any other time you’re stumped by a Black/White race issue and don’t know what to say.


Dear White son or daughter [INSERT NAME HERE], here’s what you need to know:

1) Black People and White people are different but that doesn’t mean one is better than the other. Black people look different, often eat different foods, communicate and socialize in ways that may seem strange or odd for you. But just because something is different doesn’t mean it’s bad, or that the way you do things is better. Always remember that.

2) If you don’t know something about Black people ask a lot of them. Your Black friends don’t speak for all Black people. It’s perfectly okay to not know something, because honestly unless you ask every Black person in America you really don’t know. Do you?

3) White People as a group have done terrible things to Blacks in this country – and just because they are black (not to mention Asians, Latinos and American Indians). This is a fact. You may not be personally responsible but you benefit from this fact and therefore have some responsibility. No: you never enslaved anybody, neither did your mother or I, but lots of White people did. Once slavery was over, White people spent about 100 years mistreating Blacks because they couldn’t figure out how to send them all home after that whole nation-building thing. This means that Black people used to get killed just for trying to vote, weren’t allowed to live where they wanted to, and even today some White people refuse to hire Blacks just because they are black. And while those types of things are illegal, people still do it. You benefit from this. So before you ever judge a Black person remember that other White people worked for centuries to make sure you’d be okay and Black people would stay poor.

4) Saying “nigger” is the same thing as saying “bitch.” Even though you may hear it in music, or with your friends at school you know perfectly well that you shouldn’t use that word regardless of who is in earshot. And really, why is it so important to use it anyway?

5) Always remember there is a difference between a Black neighborhood, a bad neighborhood and a poor neighborhood. Just because an area has lots of Black people doesn’t mean they’re poor or that there’s lots of crime. There are plenty of places where black people live that are nicer than our neighborhood. You should avoid any group of people that seem dangerous because of their behavior or activities, whether that’s in a trailer park or an inner city ghetto. You can get robbed by anybody.

6) No matter who your sister/brother has dated, or what your friends have told you, or how many episodes of Chappelle Show you’ve watched you do not KNOW Black people. Who or what you listen to, read, or sleep with does not make you Black. Acting like you know everything about Black people because you have some Black friends or enjoy rap music is ignorant.

7) Black people are not pets, so don’t touch them without permission, or change your voice when you’re around them, or worse: automatically try to set them up with any Black person you know. This never works out. If you’re curious about their hair just ask, you’d be amazed at some of the stuff Black folks hear all day.

8) And finally: the best way to get along with Black people is to not be oblivious. Nothing annoys Black people more than White people who pretend racism doesn’t exist and then proclaim ignorance in the face of overwhelming evidence. Just because you don’t see it, or don’t want to see it, doesn’t mean Black people are paranoid or making things up. If you think about lesson 3 you should be good on this.

I know this talk has made you uncomfortable, but your mother/father and I believe that it’s better for you to hear this at home than learning about it on the streets or from your friends. Now go out to the park and make some Black friends! But just promise me you won’t cut through those trailer parks. I heard those people are all single moms and sell crystal meth.

Debra: From what I have learned in my life of 53 years, I seriously think the race thing is promoted by whomever it benefits at the moment. Speaking from my heart, black people are created by the same God that created the rest of the people on this earth, whether they be black, white, Indian, Asian, Chinese, or one of the other races that exist.
It seems that there are only a handful of whites that are truly racist and would resort to violence against them because of their skin color and visa versa.
Having said that, one cannot help but notice that the majority of race assaults in this country are blacks assaulting whites. Occasionally, you hear of a white assaulting a black but again it is rare. Now it may or may not have been true back 100 or 200 years ago, I suspect most of the stories were true but I also suspect that we have not been told the whole story. Frankly, judging by the information that is allowed to be made known through our media today, none of us really know what percentage of white assaults on blacks were a result of personal hatred or politically motivated.
Everyone can see clearly that our current president is one who uses race to advance his political agenda. From where I sit, he is instigating violence every time he jumps to a conclusion regarding a matter when black and white both are involved. He is developing an official record that the entire world is witness to.
How many reports were there of white men preventing people from voting in the 2008 election? How many reports about Black Panthers were reported about standing outside polling places threatening people that wanted to go and vote? What did our Attorney General do about it? Nothing. But if the situation were reversed, the white men would of been crucified. That is racist by our own governments and media.
